INTRODUCTION

PRACTICE AREA: Litigation

Tom Theado is a member of the Litigation Department, where he focuses his practice on managing and conducting complex civil litigation involving a purposefully wide range of subject matters including, but not limited to, ERISA, FLSA, antitrust matters, shareholder and consumer rights, environmental injuries, real estate value diminution, personal property damage, contract damages, toxic-tort damages, and other areas responsive to his clients’ queries and needs.

A large part of Tom's practice has involved the prosecution, and the defense, of class actions and other complex civil litigations that have required him to coordinate the work of lawyers from a number of different firms throughout Ohio and nationally. In forums from Los Angeles to New Haven, Tom has prosecuted various causes of action including negligence, nuisance, fraud, and breach of contract, on behalf of regional, statewide, and nationwide classes of claimants. Many courts – locally, regionally, and nationally – have appointed Tom to serve as a Class Counsel in numerous lawsuits.

In addition to appearing as a counsel for plaintiff-litigants in many class-action lawsuits, Tom has advised and consulted in the defense of class-action matters, and he is currently actively involved in defending private and public entities against class claims. In the course of his complex-litigation practice, Tom has also participated in several multi-district litigation (MDL) proceedings.

Throughout his 45 year career, Tom has authored numerous articles related to litigation, trial practice and evidence, and class action cases, evidence, and practical techniques for trial success. Tom has also been a presenter at many legal seminars throughout the nation.

Martindale-Hubbell has awarded Tom an AV rating for preeminent legal ability and having the highest ethical standards.

LEARN MORE ABOUT TOM

Why did you begin practicing in your area of law?

In law school, I really enjoyed studying the rules of civil procedure and the rules of evidence, wondering with some happiness on how their applications became so clear and easy to me.  And then I had a year-long course in business planning which I enjoyed a lot, not that I was inclined to do corporate stuff but I found fascinating how legal solutions could be found for real-world problems.  And I've always enjoyed the stage.  So litigation – not just courtroom work but all the nuts and bolts in preparation, discerning the problems and the steps to take in resolving them – became a natural fit.  If you have ever read Zen in the Art of Archery by Eugen Herrigel, then you can have some idea of what I mean when I tell you that I love it when my work becomes practicing Zen in the art of litigation.

What quote resonates with you?

I can still hear my sainted Nana, my mother's mother, giving me yet another good reason why I should always tell the truth.  "Tommy," she'd say, "you're not smart enough to remember your lies."

What is your favorite thing about living in Northeast Ohio?

Good friends, good food, good medical care, and the seasons of the year (though "the seasons" part becomes less compelling in January and February).

What else should we know about you?

After receiving my third Nobel Prize, I asked the Committee to pass on me in the future and award the Prize to someone who needs the assurance.  And by that I mean that I strive to find fun in all that I do (even answering these questions).
